REGISTRATION OF DIPLOMAS COMMUNITY (Europe)

2 - REGISTRATION OF EXTRA DEGREES COMMUNITY (excluding Europe)
There is no registration nursing diploma extra community-level directory ADELI but licensure as an assistant caregiver is issued to any professional who has met the tests of professional knowledge and the French language which he has been invited.
For this purpose, the trader must send a file in the office ADELI consisting of:
- Original application to practice in France, signed by the professional
- Copy of diploma written in the original language
- Copy of his translation into French by a sworn translator (the coordinates of sworn translators are available from the Courts or Courts of Appeal)
- Double-sided copy of residence permit to work in France. Indeed, the licensing complements but does not replace the work permit issued by the Prefecture.
- The originals of these documents must be presented at the first test of knowledge.
If successful control of the knowledge, licensure is granted subject to compliance by the professional and his employer, the regulations concerning the employment of foreign workers.
The directory ADELI: what is it?
ADELI means Automation Schedules. It is a national information system on professionals within the public health code, the code of social action and persons authorized to use the title of psychologist. It contains information (marital status - employment status - activities). ADELI number is assigned to all employees or liberal practitioners and serves as their number. ADELI number is on the health professional card (HPC) for professionals within the public health code.
Circular DPM / DMI 2/DHOS/P 2 # 2003-101 of 3 March 2003 on the issuance of residence permits and work to nurse (s) nationals of countries outside the EEA and graduates abroad
The Minister of the Interior, Internal Security and Local Freedoms, the Minister of Social Affairs, Labour and Solidarity and the minister of health, family and people with disabilities Honours regional prefects (Regional Directorates of Health and Social Affairs [for information]); Distinguished departmental prefects ([for enforcement] Aliens Department; departmental directorates of health and social affairs; departmental labor, employment and vocational training), Mr. Commissioner of Police (for execution); Mr. Director of the Office of International Migration In the media context given the tensions on nursing employment in France and the arrival of nurse (s) foreigners to help improve the situation, it seems appropriate to recall the principles governing the exercise of the profession and the introduction in France of foreign workers.
I. - THE PRACTICE OF THE PROFESSION OF NURSING
1. Operating conditions
The practice of nursing (e) is in accordance with the Code of Public Health (Article L. 4311-2) subject to conditions of diploma, certificate or, as specified in Articles L. 4311-3 and L. 4311-4 or authorization to practice issued under Article L. 4311-11 or L. 4311-12.
The diplomas, certificates and qualifications required are:
- the French state diploma nurse or nurse;
- the diploma as a nurse issued by the University School of Nursing of the Principality of Andorra
for nationals of a Member State of the European Community or party to the Agreement on the European Economic Area or Switzerland since the agreement between Switzerland and the European Community (agreement of 21 June 1999), a diploma , certificate or title of nurse responsible for general care on a list established by the Minister for Health. This degree may be possibly accompanied by a certificate from the Member State of origin certifying that the person has completed all training requirements laid down by EU obligations.
Under current regulations, no diploma issued outside the European Community is acknowledged, as is not recognized diploma issued by a State of the European Community or EEA nationals to non-EU . Nationals of a State outside the European Community or not a party to the Agreement on the European Economic Area or Switzerland can not practice as a nurse in France.
2. The rules of practice
In accordance with the provisions of Article L. 4311-15 code of public health, nurse or nurse may not exercise his profession unless he is registered on a list compiled by the county prefect of his professional residence. The prefect, represented by the local director of health and social affairs, refused registration if the applicant does not meet the legal requirements for practice or if it is hit either a temporary or permanent ban of practice in France or abroad, or a suspension imposed under Articles L. 4311-24 or L. 4311-26.
3. Special case: the nurses and doctors
graduates outside the EU
a) Under the Decree No. 2002-1316 of 25 October 2002 on international cooperation activities of public health, nurses States whose list is determined by order of the Minister of Health may conduct training complementary form of practical training adaptation.
b) In exceptional cases and under certain conditions imposed by the circulars of the Ministry of Health, the departmental directorates of Health and Social Affairs may issue:
- To people who hold a nursing degree does not allow the exercise of that profession in France, authorization for office as a caretaker;
- To people who hold a medical degree does not allow the pursuit of his profession in France, a license to practice nursing.
These authorizations may be issued by the departmental health and social affairs that subject to compliance by the concerned rules on residence and employment of non-EU nationals on French territory.
II. - INTRODUCTION TO FRANCE FOR FOREIGN NURSES
Given the known needs in this profession, nurses nationals of countries outside the European Union or party to the European Economic Area have expressed a desire to work in France. In addition, intermediaries have offered to put in contact with nationals of these countries with public health.
In this context, it should be especially careful not to issue work permits to holders of a diploma recognized on the territory or licensing, under the conditions below.
1. The conditions for issuing work permits in France
Section L. 341-4 of the Labour Code stipulates that a foreigner can not exercise a professional activity in France without obtaining the prior authorization.
The procedure for introducing a foreign worker is at the initiative of the employer who files an application with the local office of the ANPE must publish the vacancy and forward the request for introduction DDTEFP.
The record must include:
- authorization to practice issued by the DDASS or one of the diplomas listed above;
- Copy of deposit offer to ANPE;
- 2 photographs.
DDTEFP decide whether to accept the request based on the items referred to in Article R. 341-4 of the Labour Code.
If locally, the employment situation can not be opposed to a foreign national with a work contract or a promise of employment for a job as a nurse (e) other conditions required for the issuance of the permit must be met: compliance with labor regulations, employment conditions and wages similar to those enjoyed by French workers, the measures taken by the employer to provide or to ensure, in normal conditions, the housing worker.
As this demand for change of status from an alien legally residing in French territory, it is lodged by the applicant himself to the prefecture is home. You teach by following the requirements for adjustment of status contained in Circular DPM / DMI 2/2002/26, 16 January 2002 concerning the processing of applications for work permits for foreigners.
In the absence of licensing or from one of the qualifications mentioned in Article L. 4311-3 Code of Public Health or non-compliance with the nationality requirement, the work permit should be denied.
2. The monopoly of the Migration Office (OMI)
In accordance with Articles L. 341-9 and R. 341-9 of the Labour Code, the IMO is who is responsible, on an exclusive basis for carrying out recruitment in France and the introduction of foreign immigrants.
The same article L. 341-9 states that "it is forbidden for any individual or group other than the office to engage in these operations." In addition, any violation of the provisions referred to above shall be sentenced to 3 years imprisonment and a fine of 3 000 EUR and is to intervene or attempt to interfere, as usual, and as a means to any stage of the recruitment and introduction of foreigners is punishable by 5 years imprisonment and a fine of 3 000 EUR (Article L. 364-6 of the Labour Code).
The law regulates therefore, very precisely, the conditions for introduction in France of foreign workers and can not be waived.
Therefore, no assignment in France can be done without using the services of the IMO.
3. Issuance of residence permits and work permits
Upon his arrival in France as part of the procedure of introduction of foreign workers under the guise of long-stay visa regulations, or upon obtaining a work permit under the instruction of an application change of status, the foreigner must apply to the DDASS department where he establishes his residence professional, his inclusion on the departmental list of nurses.
He must also undergo medical examination at the IMO by his employer after payment of the fee and lump sum contribution.
Upon presentation of the work contract stamped by the DDTEFP, certificate of registration on the departmental list of nursing and medical certificate issued by the IMO, he is given a temporary residence permit (CST) "employee".
4. Foreign students admitted to nursing school (s)
Foreign nationals whose nursing diploma is not recognized in France, and who were admitted to a school in a school nurse (s) in France, will receive a temporary residence permit (CST) "student" if they meet all legal requirements and prescribed for admission to stay in student status.
To enable them to attend courses required for graduation, they will be issued temporary work permits (APT) for the duration of these courses in schools or services authorized for that purpose.
INTRODUCTION TO EFFECTIVE COMPETITION IFSI
To be eligible for entrance into IFSI, you must present a certificate from the Consulate or Embassy, stating that the title he has allows him to enter university in his country (Decree No. 81-1221 of 31 December 1981 on the reception of foreign students in universities and public scientific and cultural independent universities, art. 16 and 18).
Holders of degree or diploma in nursing from abroad to a country outside the European Union or European Economic Area or the Principality of Andorra or the Swiss Confederation and who wish to practice in France must to attend the selection trials to enter an institute of nursing education for graduation from state nurses.
Clearly, graduates from all countries outside the EU must retake the entrance of a nursing school French (but according to specific tests different from other candidates) to do their schooling and pass the diploma State.
CONDITIONS OF ENTRY
To submit to the tests referred to in Article 1 of this Order, applicants should contact the Institute of Nursing Education of their choice with an application form:
certified photocopy of their diploma in nursing (the original will be provided upon admission to the program);
detailed statement of the curriculum followed, including the number of hours per subject per year of training, duration and content of clinical placements made during training and the record of continuous assessment, all issued and certified by a competent authority in the country which issued the diploma;
- curriculum vitae;
- a letter of motivation;
- translation into French by a sworn translator of all these documents.
TESTS OF SELECTION
The selection tests referred to in Article 1 are threefold:
- a test of eligibility;
- an admissions test.
The test for eligibility
The eligibility test is a written examination and anonymously with five general knowledge questions to assess in particular the control of the French language by the candidate, and his knowledge, primarily in health and social development. This test lasting one hour and thirty minutes is worth 20 points.
To qualify, candidates must obtain a score in this event at least 10 of 20
The admission test
The candidates declared eligible by the jury are allowed to sit for entrance examinations consisting of an oral test and a situational practice, organized in one sitting.
The oral examination for a period of thirty minutes or less consists of an interview in French with two people, members of the jury:
a nurse working in health executive training institute in nursing;
health nurse part of practicing in an institution or a home service, character health, social or medico-social.
This test is to assess the professional background and motivations of the candidate from his application form. It is scored on 20 points.
The test scenario practice focuses on:
study of a clinical case related to professional practice nurse whose subject is drawn by the candidate from the questions prepared by the jury;
carrying out two acts of care, in conjunction with the clinical case, classroom assignments, one under Article 5 and the other of Article 6 of the Decree of 11 February 2002 aforesaid.
This test must allow the jury to assess the capacity of understanding and analysis of a given care situation and the technical skills of the candidate.
Lasting one hour and thirty minutes, thirty minutes of preparation, the test is scored on 20 points and is evaluated by the same jury that the oral test. A score below 10 in 20 is eliminated.
To be admitted into an institute of nursing education, candidates must obtain a score of at least 30 out of 60 in three rounds of selection.
Following the admission tests and the marks obtained in three tests of selection, the foreman makes a master list and a supplementary list. The latter should help fill the vacancy of any withdrawals.
In case of a tie between two or more candidates, the rank classification is determined by their score in written test and then the situational practice. When this procedure failed to separate the candidates, the oldest candidate will be ranked ahead of others.
WAIVERS OF TRAINING
The director of the Institute of Nursing Education, after consultation with the technical advice, is empowered to exempt students admitted in formation of the first or first two years of study. This decision is based on the level of training of nurse candidates, selection test scores and work experience.
For foreign doctors, there are two cases. The first case involves a brief training at IFSI and graduation by state tests and procedures they are specific. In this case, doctors will be considered legally the same way as nurses, that their situation is handled on a case by case basis principals IFSI. However, they have more "easy" to get the state diploma. They will do an internship in service and a probation report to be considered the equivalent of TFE and finally pass an MSP after completing 15 days of training to the nursing process.
But there is another solution to be hired directly by the institution without prior training.
1. With training
Persons holding a doctoral degree in medicine have, as of December 31, 2004, a total exemption of theoretical, subject to follow, within the limits of available places, an institute of nursing education their choice, a two-week teaching on the nursing process and to intern full-time nursing for a period of two months. The terms of probation are determined, after review of technical advice by the Director of the institute of nursing education chosen by the candidate.
DIPLOMA OF STATE

Getting Professional Status
The scenario work takes place during the last fortnight of last month internship.
The test consists of a support group of two to ten patients after the nature of service and care. The duration of this test, between two and four hours, varies depending on the number of people treated supported. This test is denoted by sixty points, including:
Thirty points for the summary presentation of patients cared for and argument care projects;
Thirty points for the organization and implementation of care.
The care should help to assess the particular relational capacity of the student and his dexterity gesture. A score below 30 to 12 on the implementation of care will be eliminated and a score below 21 on 60 in the entire examination. Potentially dangerous one care for the patient leads a score of 0 out of 30. The evaluation of the test is provided by a teacher from another training institute that to which the student and practicing nurse for at least three years and have participated in ongoing assessments of schooling.
2. Without training
Another solution exists for physicians. Indeed, according to the circular DHOS-P 2 No. 2001-388 of 1 August 2001 institutions, public or private bodies involved in public service or not, may apply to the directors of DDASS permission to hire foreign doctors to work as nurse (the demand comes from the establishment recruiter).
The authorization granted for a maximum period of three years, is granted by the local director of health and social affairs. The application of the institution that wishes to recruit a physician who holds a foreign degree or accompanied by a photocopy of the original medical degree from the person concerned and, if necessary, its translation by an accredited translator French .
